ARTICLE 1 : GENERAL CONDITIONS – SPECIAL CONDITIONS

These general terms and conditions of sale (“General Terms and Conditions of Sale”) govern the relationship between Siam Thai Massage SARL (hereinafter “Siam Thai Massage” or the “Company”) and the Client (“Client”), collectively with Siam Thai Massage the “Parties”, in the context of the sale of products and the provision of services by Siam Thai Massage, as requested in-store by the client. Special conditions contractually agreed upon and applicable to a specific Siam Thai Massage product (“Special Conditions”) may complement or modify the General Terms and Conditions of Sale.

The General Terms and Conditions of Sale together with the Special Conditions and the client’s request form the contract (“Contract”).

ARTICLE 2 : PROVISION OF SERVICES

Siam Thai Massage commits to providing its services and supplying the necessary equipment for the proper execution of the service provisions. The company also commits to making available its qualified, experienced personnel who meet the subscriber’s needs.

Siam Thai Massage offers only relaxing massages which aim solely at relaxation and are not physiotherapeutic massages.

The various services offered by Siam Thai Massage are available to any adult person, or minor with authorization from their legal guardian who has read and accepted these General Terms and Conditions of Sale in their entirety.

The services provided by Siam Thai Massage are strictly related to wellness and relaxation massages. They cannot be equated to therapeutic massages provided by physiotherapists and health professionals. Erotic or sexual services are excluded. Any inappropriate behavior towards the practitioner will immediately terminate the service, which will be considered due and may be subject to legal proceedings.

All medical problems whatsoever must be reported before the massage session to the management of Siam Thai Massage or the practitioner. Some diseases are incompatible with massage; in this case, the massage may still be carried out with medical authorization from a doctor approved by the government of the Grand Duchy of Luxembourg.

Pregnant women must notify the practitioner of their pregnancy status before any services, as some massages are strongly discouraged during the gestation period and all massages should be avoided during the first three months as well as the last month of pregnancy.

Siam Thai Massage will not be responsible for any medical problems whatsoever following each session. The intensity and type of massage are performed at the client’s request.

Any delays to a session will be automatically deducted from the initially planned massage time between the Parties. The non-appearance of the Subscriber at a session will be charged during their next service.

ARTICLE 3 : GIFT VOUCHERS

Siam Thai Massage offers its clients gift vouchers. These are limited in duration as indicated. The validity period of the gift voucher is usable for a period of 6 months from the date of sale without the possibility of extension or partial refund. After this date, the gift voucher may be considered invalid and thus definitively lost for the client.

The gift vouchers work by the duration of the massage, either 60 minutes or 90 minutes. If the beneficiary wishes to have a massage with a price or duration lower than that of their gift voucher, no refund or credit will be possible.

In the other case, if a person wishes a massage of a duration or price higher than the value of their gift voucher, this person will have to pay the difference between their gift voucher and the desired treatment(s).

In the case where a person in possession of a gift voucher makes a reservation which they do not attend, the gift voucher cannot be simply canceled and therefore cannot be used for a second appointment.

The gift voucher can be used only once and must be handed over on the day of the appointment to enjoy the service.

ARTICLE 4 : CONTENT

The Subscriber authorizes Siam Thai Massage to use their personal information for advertising purposes, without prior authorization and without financial compensation.

ARTICLE 5 : NON-COMPETITION CLAUSE

The subscriber agrees not to directly or indirectly engage any personnel from Siam Thai Massage for the duration of the present contract plus one year.
In case of non-compliance with this provision, the Subscriber will pay Siam Thai Massage a lump sum equivalent to 2 years of the gross salary that the employee concerned received at the time of their engagement with Siam Thai Massage.

ARTICLE 6 : APPLICABLE LAW AND JURISDICTION:

These general terms and conditions of sale are subject to Luxembourgish law.
Any disputes that may arise between Siam Thai Massage S.à r.l. and the Subscriber regarding the execution of the Order Form will be submitted to the courts of the domicile of the Grand Duchy of Luxembourg.
However, Siam Thai Massage S.à r.l. reserves the right to take action against the Subscriber at their place of domicile or residence or before any other competent court.

ARTICLE 7 : ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

Siam Thai Massage will consider that any person accepting a relaxing treatment has read

and accepted these General Terms and Conditions, which are visible and accessible to each client at the massage institute at 72, Grand Rue L-1660 Luxembourg or in any premises or company where one of our practitioners provides care.
